In our experience, many policyholders are unaware that the Florida Statutes provide that an insurer generally pays the attorney’s fees of a policyholder that prevails in a lawsuit. The importance of this fact is that it becomes possible in many cases to offer a contingent fee contract where the attorney agrees to accept the court-awarded attorney’s fees as payments, meaning that under such a circumstance that the client does not pay out-of-pocket for attorney’s fees nor are the fees paid out of the policyholder’s insurance benefits. Because the decision to take a case on a contingency fee arrangement requires an analysis of the merits of the case, Schropp Law Firm cannot make a determination as to whether it will take a case under a contingency fee arrangement without a consultation. However, it is important that prospective clients be aware that it is often possible to retain insurance coverage counsel under such an arrangement. Moreover, in situations involving a contingency fee contract, it is also often possible for Schropp Law Firm to structure the contingency fee contract such that there are no out-of-pocket costs for the client during litigation and no costs charged to the client whatsoever if the litigation is unsuccessful, although this may vary depending on the nature of the case.
